{"id":13588,"date":"2022-02-21T18:22:55","date_gmt":"2022-02-21T18:22:55","guid":{"rendered":"https:\/\/www.cnajmj.fr\/droits_obligations\/paiement-salaire-procedure-collective\/"},"modified":"2024-08-29T08:37:58","modified_gmt":"2024-08-29T08:37:58","slug":"paiement-salaire-procedure-collective","status":"publish","type":"droits_obligations","link":"https:\/\/www.cnajmj.fr\/en\/droits_obligations\/paiement-salaire-procedure-collective\/","title":{"rendered":"Who pays wages in the event of collective proceedings?"},"content":{"rendered":"\n<p>The AGS, <em>Association pour la gestion du r\u00e9gime de Garantie des cr\u00e9ances des Salari\u00e9s<\/em>, (Association for the management of the Employee Debt Guarantee Scheme) is an organisation that takes over the payment of wages and salaries in the event of non-payment by a company in <a href=\"https:\/\/www.cnajmj.fr\/en\/guide_pratique\/receivership\/\">receivership<\/a> or <a href=\"https:\/\/www.cnajmj.fr\/en\/guide_pratique\/judicial-liquidation\/\">liquidation proceedings<\/a>, up to a certain ceiling.<\/p>\n\n\n\n<p>The AGS&#8217;s involvement presupposes the opening of insolvency proceedings (receivership \/ judicial liquidation) and the company&#8217;s lack of funds to pay wages and social security contributions. In the event of a <a href=\"https:\/\/www.cnajmj.fr\/en\/guide_pratique\/judicial-liquidation\/\">judicial liquidation<\/a>, employment contracts are terminated.<\/p>\n\n\n\n<p>Wages, bonuses, compensation, social security contributions and other claims arising from the termination of the contract are guaranteed, subject to certain ceilings.
