A judgment opening collective proceedings is automatically enforceable on a provisional basis.<\/p>\n\n\n\n

This means that it becomes effective even before any remedies have expired and continues to be effective even if appeals are lodged, unless provisional enforcement is suspended.<\/p>\n\n\n\n

The opening judgment may be appealed by :<\/p>\n\n\n\n

  1. the debtor,<\/li>\n\n\n\n
  2. the pursuing creditor,<\/li>\n\n\n\n
  3. the public prosecutor.<\/li>\n<\/ol>\n\n\n\n

    In the event of the opening of a judicial liquidation<\/a> procedure, the Social and Economic Committee may also lodge an appeal against the judgment.<\/p>\n\n\n\n
