What social security/additional health insurance cover is available to employees in the event of a judicial liquidation?

The “portability” system set out in article L.911-8 of the French Social Security Code enables employees to retain the collective health and life insurance policies they benefited from prior to the termination of their employment contracts.

This applies to both compulsory and optional cover, as long as the employees were covered prior to the termination of their employment contracts. 

The application of this mechanism for maintaining cover to all employees without distinction is applicable to former employees made redundant following the judicial liquidation of the employer (French Court of Cassation, 31 July 2017).

This system is only applicable if the contract between employer and insurer has not been terminated prior to the initiation of the proceedings.
