What happens to employees of a company during collective proceedings?

The opening of safeguard, reorganisation or judicial proceedings entails the election of an employee representative. The employee representative must be an employee with an employment contract.

In addition to the information that may be obtained by the usual bodies (Works Council or Social and Economic Committee), the employee representative acts as an information relay between the employees, the court and the parties involved in the proceedings. 

He or she has a role in the verification procedure for employee claims, can assist or represent an employee before the industrial tribunal, and is informed of any offer to take over the company and of the progress of the collective proceedings.
